Are You Entitled to Benefits?
The survivors of someone who died during the course and scope of employment may be entitled to benefits pursuant to the Workers’ Compensation Act of Louisiana.
In order to be eligible for work comp death benefits, you must meet the following:
- You are the surviving spouse or a dependent child of the deceased employee
- If the deceased employee had no surviving spouse or dependent children, the surviving parents may be eligible for a lump sum payment
What Benefits Are Available?
The death benefit provides payment for all or part of funeral expenses and provides weekly payments representing a percentage of the deceased employee’s wages. The percentage is based upon marital status and number of dependents of the deceased at the time of his or her death or, if the deceased was unmarried and without dependents, then the surviving parents are eligible for a lump sum payment of $75,000 each.
